Terms of Service — serviciosaereos.cl (English)

These Terms of Service (“Terms”) govern access to and use of serviciosaereos.cl (the “Platform”), a job marketplace for manned aviation and unmanned aviation (UAS/RPAS), by Candidates and Companies/Employers (together, “Users”).

1) Definitions

Platform: serviciosaereos.cl and its features (accounts, profiles, job posts, applications, messaging, etc.).

Candidate: a natural person who creates a profile, uploads a CV/documents, or applies to jobs.

Company / Employer: an organization that creates an account to post jobs or manage recruitment.

Content: information uploaded or published by Users (job posts, profiles, CVs, documents, messages).

Paid Services: plans, subscriptions, and add-ons (featured listings, boosted jobs, candidate database access, etc.), if offered.

2) Acceptance

By creating an account, publishing Content, or using the Platform, you confirm that you have read, understood, and accepted these Terms. If you do not agree, do not use the Platform.

3) Eligibility and Account Registration

You must provide accurate, complete, and up-to-date information.

You are responsible for safeguarding your credentials and all activity under your account.

We may request reasonable verification to prevent fraud or abuse.

4) Scope of the Platform (What we do / don’t do)

The Platform:

Enables job posting and candidate applications.

May provide tools for filtering, communication, and application management.

The Platform does not:

Guarantee hiring outcomes, employment continuity, or selection results.

Become a party to any employment contract between Employers and Candidates.

Verify licenses/certifications by default unless explicitly offered as a separate service.

5) Candidate Rules

Candidates agree to:

Not submit false, misleading, or incomplete information (including licenses/certifications).

Not upload Content that violates third-party rights (IP, confidentiality, personal data).

Keep profile details reasonably updated.

Profile/CV visibility:
The Platform may offer visibility settings (e.g., “only employers I apply to” vs. “visible to registered employers”). Your selected settings determine what Employers can access.

6) Employer Rules (Critical Obligations)

Employers agree to:

Post genuine job opportunities with lawful and non-discriminatory content.

Use Candidate data only for recruitment and selection purposes related to the job(s).

Not sell, transfer, republish, scrape, or commercially exploit Candidate CVs/data.

Candidate database / CV search (if offered):

Access must respect Candidate visibility settings and consents.

Mass downloading, scraping, or building parallel databases without a lawful basis and retention policy is prohibited.

7) Prohibited Content and Restricted Conduct

You must not:

Publish unlawful, defamatory, misleading, or fraudulent content.

Request or publish sensitive data unless strictly necessary and legally permitted.

Attempt to compromise security, reverse engineer, scrape, brute force, or bypass access controls.

Impersonate any person or organization.

We may remove Content or suspend/terminate accounts where there is a reasonable basis to believe these Terms have been violated.

8) Intellectual Property and License to Use Content

The Platform, including its software, branding, and design, is owned by the Platform operator or licensors.

Users retain ownership of their Content. However, by uploading Content, you grant the Platform a non-exclusive license to host, process, display, and deliver such Content as necessary to operate the service (e.g., forwarding an application to an Employer), including making technical copies for backups and security.

9) Privacy and Personal Data

Personal data is processed in accordance with the Platform’s Privacy Policies (Candidate and Employer versions) and applicable Chilean data protection rules. You agree to comply with all applicable privacy and employment regulations when using the Platform.

10) Payments, Billing, and Refunds (If Applicable)

Prices, plan terms, and included features will be displayed on the Platform at checkout or on the pricing page.

If refunds/retractions are offered, they will be governed by the Platform’s Refund Policy and applicable consumer protection rules, where relevant.

Chargebacks initiated without first contacting support may result in temporary suspension of access to Paid Services while the dispute is reviewed.

11) Platform Availability

We may perform scheduled or emergency maintenance. We do not guarantee uninterrupted availability, but we will take reasonable steps to maintain continuity.

12) Suspension and Termination

We may suspend or terminate accounts:

To protect Platform security or prevent fraud/abuse;

For material or repeated violations of these Terms;

When required by law or valid authority request.

We may retain minimal technical records for security/audit and legal compliance purposes, consistent with the applicable Privacy Policy.

13) Disclaimer and Limitation of Liability

To the maximum extent permitted by law:

The Platform is provided “as is” and “as available.”

The Platform is not responsible for Employer hiring decisions, Candidate conduct, or the accuracy of third-party Content.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost opportunities.

If Paid Services apply, any liability may be limited to the amount paid by the User in the last [30/60/90] days, except where the law does not allow such limitation (e.g., willful misconduct or gross negligence).

14) Indemnification

You agree to indemnify and hold the Platform operator harmless from claims arising out of:

Your Content or use of the Platform;

Your breach of these Terms;

Misuse of personal data (especially by Employers);

Any violation of applicable law.

15) Governing Law and Jurisdiction

These Terms are governed by the laws of Chile. Any disputes will be submitted to the competent courts of [insert city/region], without prejudice to any mandatory rights that cannot be waived.

16) Changes to these Terms

We may update these Terms from time to time. The current version will be posted with a “Last updated” date. Continued use of the Platform after changes become effective constitutes acceptance.

Implementation Notes (Fill-in Items)

Insert: legal entity name, RUT, address, and jurisdiction city.

Confirm whether the Platform offers: messaging, CV database search, subscriptions/add-ons.

Define: liability cap window (30/60/90 days) and retention periods aligned with Privacy Policy.

If you tell me whether you will have (1) a searchable CV database and (2) internal messaging, I’ll lock the language precisely to those features (and remove any optional clauses you won’t use).
